Terms of Service

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@sellcre.ai of any unauthorized use of your account.

2. The Service

SellCRE generates commercial real estate marketing materials from information you provide, such as property addresses and brokerage details, together with data drawn from third-party and public sources. The Service is a tool to assist you; it does not provide legal, financial, appraisal, brokerage, or investment advice.

3. User Content and Responsibilities

“User Content” means any information, data, text, images, property addresses, brokerage information, and other materials you submit to the Service. You represent and warrant that you have all rights necessary to submit your User Content and that it does not infringe the rights of any third party or violate any law.

You are solely responsible for the accuracy and completeness of the information you provide and for ensuring that your use of the Service and any output complies with applicable real estate, advertising, and fair housing laws and with the rules of any brokerage, board, or regulatory body to which you are subject.

4. AI-Generated Content — Review Required

The Service uses artificial intelligence to draft narratives, highlights, descriptions, maps, and other content. AI-generated content may contain errors, omissions, or inaccuracies and may not reflect current property conditions, market data, or legal requirements.

You acknowledge and agree that all AI-generated content must be independently reviewed, verified, and approved by you — a licensed broker or qualified real estate professional — before it is relied upon, published, or distributed. SellCRE is not responsible for any decision made, or action taken, in reliance on unreviewed AI-generated content.

5. Ownership of Output

As between you and SellCRE, you own the Offering Memorandums, attraction maps, email templates, and other documents that the Service generates from your User Content (“Output”), subject to your payment of all applicable fees. You may use, edit, and distribute your Output for your own commercial real estate marketing purposes.

You grant SellCRE a limited license to host, process, and display your User Content and Output solely as necessary to provide and improve the Service. SellCRE and its licensors retain all rights in the Service itself, including its software, templates, designs, and underlying technology.

6. Comparable License (Public Facts of a Published Package)

The Service includes a comparables library that helps brokers research recent transactions and asking rents. To make that library useful, SellCRE may surface the “Public Facts” of a Package you publish on the Service to other SellCRE users.

“Public Facts” means information that is rendered on the published brochure itself — for example, the property address, asset class, sale price or asking rent, transaction date, and any other figures or descriptors that appear on the brochure’s pages. Public Facts do not include information you store on SellCRE but choose not to publish, including without limitation your client identities, internal notes, draft state, financial documents, or anything stored on SellCRE outside the published artifact.

By publishing a Package on SellCRE, you grant SellCRE a non-exclusive, worldwide, royalty-free, sublicensable license to use the Public Facts of that Package as candidate comparables surfaced to other SellCRE users in their own research workflows. The license includes the right to display, aggregate, summarize, and cite the Public Facts in another User’s research view and in artifacts that User generates from the Service.

The license is perpetual for any Public Facts that have been cited in another User’s published artifact prior to your opt-out — such artifacts cannot be retroactively edited, and the Public Facts already cited there will remain. For all other purposes, the license is revocable: opting out in Account → Privacy removes your Public Facts from future comparable searches within five (5) business days of the opt-out request.

SellCRE reserves the right to update this section’s terms upon thirty (30) days’ advance email notice to your account address. Continued use of the Service after the effective date constitutes acceptance.

7. Payments, Plans, and Refunds

The Service is offered on a one-time purchase basis (per property) and on a recurring monthly subscription basis. Pricing is described on our pricing page. Payments are processed by our third-party payment processor, Stripe; by submitting payment information you agree to Stripe’s applicable terms.

Subscriptions renew automatically each billing period until cancelled. You may cancel at any time, and you will retain access through the end of the current billing period; cancellation does not entitle you to a refund of fees already paid. One-time purchases grant the access described at the point of purchase. If you believe you have been charged in error, contact us at support@sellcre.ai.

8. Acceptable Use

You agree not to use the Service to: violate any law or third-party right; submit false, misleading, or unlawful content; infringe intellectual property; transmit malware; attempt to gain unauthorized access to the Service or its systems; scrape or reverse engineer the Service; or interfere with the operation of the Service or its use by others.

9. Third-Party Services

The Service relies on third parties, including payment processing, AI model providers, mapping and property-data sources, and hosting infrastructure. We are not responsible for the availability, accuracy, or content of third-party services, and your use of them may be subject to their own terms.

10. Disclaimers

The Service and all Output are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. SellCRE does not warrant that the Service will be uninterrupted or error-free or that any Output will be accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, SellCRE and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. SellCRE’s total liability for any claim relating to the Service will not exceed the amount you paid to SellCRE in the twelve months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless SellCRE from any claims, damages, liabilities, and expenses arising out of your User Content, your use of the Output, or your breach of these Terms or of applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use poses a risk to the Service or to others. Provisions relating to ownership, disclaimers, limitation of liability, and indemnification survive termination.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
